This document explains the terms governing your use of www.goodelevation.co.za, purchases made through our website and how we handle your personal information.

Part A contains our Terms of Service. Part B contains our Privacy Policy.

Please read this document together with our Shipping Policy and Returns Policy. Nothing in this document limits your rights under applicable South African law.

PART A — TERMS OF SERVICE

1. About Good Elevation

Good Elevation embraces simplicity in choosing what to wear by offering carefully curated, complete outfits.

Our human stylists select and combine clothing and footwear into coordinated looks. Technology and AI support personalised recommendations based on the measurements, preferences, style and budget you provide.

2. Using Our Website

You must be at least 18 years old, or have the assistance and consent of a parent or legal guardian, to place an order.

You agree to provide accurate and complete information when creating an account, completing our style quiz or making a purchase.

You may not place fraudulent orders, use payment details without authorisation, access accounts or systems without permission, introduce malicious software, disrupt the website, commercially exploit protected content without permission or engage in unlawful activity.

By placing an order, you agree to the purchase terms applicable at that time. This does not constitute blanket consent to the processing of your personal information.

3. Customer Accounts

You are responsible for keeping your account login details confidential and notifying us if you suspect unauthorised access.

Where account features are available, you may view orders, update your details and preferences, access saved looks and submit return requests.

Please keep your contact details, delivery address, measurements and preferences up to date.

We may restrict or suspend an account where there are reasonable grounds to suspect fraud, unlawful activity or misuse. This will not remove your rights concerning valid existing purchases.

4. Complete Outfit Purchases

Good Elevation sells complete outfits consisting of three pieces: a top, a bottom and a pair of shoes, as described on the relevant product page.

The displayed outfit price covers the complete look. Individual pieces are not available for separate purchase through our complete-outfit offering.

Please review the outfit contents, product descriptions and selected sizes before completing your purchase.

Accessories or other items shown for presentation purposes are included only where expressly stated in the product description.

We will not substitute a piece, size or colour in your order without your agreement.

5. Recommendations, Sizing and Product Information

Our recommendations depend on the accuracy of the information you provide. They assist your selection but do not guarantee a particular fit or personal preference.

Sizing may differ between brands. Please consult the available size information and check your measurements before ordering.

We take reasonable care to ensure that product descriptions, images and prices are accurate. Colours may appear differently because of screen settings, lighting or photography.

Your rights remain unaffected where goods supplied materially differ from their description or fail to meet applicable quality requirements.

6. Prices and Payment

All prices are displayed in South African Rand (ZAR) and include VAT.

Free shipping applies to orders delivered within our supported delivery areas, as described in our Shipping Policy.

The total amount payable will be displayed before you confirm your purchase. Any applicable additional charges must be disclosed before payment.

Payment must be made using a payment method available at checkout. Orders are subject to successful payment and reasonable fraud verification.

Prices may change for future purchases. A price change will not alter the price of an order already accepted.

If we identify an obvious pricing or listing error, we will contact you to explain the error and resolve the order in accordance with applicable law. Any amount due back to you will be refunded.

7. Orders and Acceptance

Before submitting your order, you will have an opportunity to review your selections and correct errors.

An automated order acknowledgement confirms that we have received your order. Acceptance occurs when we confirm that your order has been accepted for fulfilment.

We may decline an order if payment is unsuccessful, goods are unavailable, the supplied address falls outside our supported delivery areas or there are reasonable grounds to suspect fraud or an unauthorised transaction.

If we cannot fulfil an order after receiving payment, we will notify you and refund the amount due in accordance with applicable law.

8. Stock Availability

All outfits and sizes are subject to stock availability.

If an ordered outfit or size becomes unavailable, we will notify you promptly. You may agree to an alternative or receive a refund for the unavailable goods.

We will not replace your selected outfit or any of its pieces with an alternative without your agreement.

Items saved to a wishlist or placed in a shopping cart are not reserved unless we expressly confirm otherwise.

9. Delivery

Available delivery areas and estimated delivery times are set out in our Shipping Policy or communicated during checkout.

You are responsible for providing a complete and accurate delivery address and a contact number. Please notify us promptly if these details need to change.

Delivery estimates may be affected by circumstances beyond our reasonable control. If a delay occurs, we will communicate the available information and assist with resolving the issue.

Your statutory rights relating to delayed or failed delivery remain unaffected.

Responsibility for loss or damage remains with Good Elevation until delivery to you or a person you have authorised to receive the order.

Please report missing, damaged or incorrect goods as soon as reasonably possible. A delay in reporting does not automatically remove your statutory rights.

10. Order Cancellations

If you wish to cancel an order before dispatch, contact sboniso@goodelevation.co.za promptly and provide your order number.

We will confirm whether dispatch can be stopped. If the order has already been dispatched, the applicable return process will apply.

Where a statutory cancellation right applies, we will honour that right and process any refund within the applicable legal period.

11. Seven-Day Returns

You may request a change-of-mind return within seven calendar days after receiving your order.

For an ordinary change-of-mind return, the complete outfit must be returned together. Items should be unworn, unwashed and unaltered, with original tags attached and original packaging included where reasonably possible. Items may be tried on carefully to assess fit.

These conditions do not override statutory cancellation or defective-goods rights.

To request a return, select “Log a Return” on our website or email sboniso@goodelevation.co.za with your order number and details of your request.

Where the Electronic Communications and Transactions Act cooling-off right applies, you may cancel without giving a reason or paying a penalty within seven days after receiving the goods. Only the direct cost of returning the goods may be charged, and the refund will be made within 30 days of cancellation.

For ordinary change-of-mind returns, any direct return cost will be explained before collection or dispatch.

Good Elevation will bear the applicable return costs where goods are defective, damaged on delivery or incorrectly supplied.

Please refer to our Returns Policy for the return procedure. If a policy provision conflicts with a mandatory legal right, that legal right takes precedence.

12. Defective, Damaged or Incorrect Goods

The seven-day change-of-mind period does not limit your rights concerning defective, unsafe or incorrectly supplied goods.

Where the Consumer Protection Act applies, goods that fail to meet statutory quality requirements within six months after delivery may be returned without penalty and at our risk and expense. You may choose a repair, replacement or refund as provided by law.

We may reasonably inspect the goods to establish the reported issue.

We will not require you to return unaffected outfit pieces merely to exercise a statutory right concerning a defective piece, unless reasonably necessary to complete the remedy.

Damage caused by misuse, unauthorised alterations or failure to follow reasonable care instructions will be assessed in accordance with applicable law.

13. Refunds and Exchanges

Approved refunds will ordinarily be made to the original payment method unless another lawful arrangement is agreed.

Refunds will be processed within the applicable legal period. Your bank or payment provider may require additional processing time before the funds appear in your account.

Exchanges depend on stock availability and will be discussed with you before being arranged.

Where you are entitled to a monetary refund, we will not replace it with store credit without your agreement.

14. Promotions and Offers

Promotions are subject to the conditions displayed with the relevant offer, including validity periods, qualifying purchases and usage limits.

Unless expressly stated otherwise, promotional offers cannot be combined.

Any price reduction or promotional benefit will be shown before you complete payment.

Promotional purchases remain subject to applicable statutory consumer rights.

15. Intellectual Property

The Good Elevation name, branding, original website content and outfit presentations are owned by, or licensed to, Good Elevation.

You may browse and use the website for personal shopping purposes. You may not reproduce, distribute or commercially exploit protected content without permission.

Third-party brand names, trademarks and logos belong to their respective owners. Their appearance does not, by itself, imply an endorsement or partnership.

16. Third-Party Services and Links

Our website may use third-party services for payments, delivery and other shopping functions, or contain links to external websites.

External websites may have their own terms. Please review those terms when using their services.

Our use of third-party providers does not remove our obligations to you concerning purchases made from Good Elevation.

17. Website Availability and Liability

We take reasonable steps to maintain an accurate and functional website. Temporary interruptions may occur because of maintenance or technical problems.

To the extent permitted by law, Good Elevation is not responsible for indirect losses arising solely from website interruptions or unauthorised misuse of your account.

Nothing in these terms excludes liability for fraud, gross negligence, statutory product liability or any liability that cannot lawfully be excluded.

18. Complaints and Disputes

If you have a complaint concerning an order or our service, please email sboniso@goodelevation.co.za with your order number, a description of the issue and relevant supporting information.

We will investigate and seek a fair resolution.

You retain the right to approach an applicable ombud, consumer authority or court. Nothing in these terms requires you to waive those rights.

19. Applicable Law

These terms are governed by the laws of the Republic of South Africa.

Any dispute will be dealt with by a court or dispute-resolution body with lawful jurisdiction, subject to your applicable consumer rights.

20. Changes to These Terms

We may update these terms by publishing a revised version on our website with an updated date.

Changes apply prospectively and will not reduce your rights under an existing order.

The terms applicable when your order was placed will continue to govern that purchase, unless a change is required by law or agreed with you.

21. General Provisions

If any provision is found unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

A delay in enforcing a provision does not amount to a waiver of that provision.

These terms and the policies expressly incorporated into them govern your purchase, subject to any additional terms expressly agreed with you and your mandatory legal rights.

PART B — PRIVACY POLICY

22. Our Commitment to Privacy

Good Elevation respects your privacy and is committed to processing personal information lawfully, fairly and securely.

This policy explains how we collect, use, share, store and protect personal information when you visit our website, complete our style quiz, create an account, place an order or communicate with us.

We process personal information in accordance with applicable South African law, including the Protection of Personal Information Act, 2013 (POPIA).

Good Elevation Group (Pty) Ltd is the responsible party for personal information whose processing purposes and means we determine.

23. Scope of This Privacy Policy

This policy applies to personal information processed through website visits, customer accounts, our style quiz, personalised recommendations, purchases, payments, deliveries, returns, exchanges, refunds, customer support, complaints, permitted marketing communications and website security activities.

Personal information means information relating to an identifiable person, including information that can identify you directly or when combined with other information.

24. Information We Collect

We collect information relevant to the service you use.

24.1 Contact and Account Information

We may collect your name, surname, email address, telephone number, billing and delivery addresses, account identifiers, authentication information, account preferences and communication choices.

24.2 Style Quiz and Sizing Information

Depending on the questions you complete, we may collect your age, gender or preferred shopping range, height, weight, waist size, shirt size, shoe size, body-shape selections, fit and proportion preferences, garment-length preferences, colour choices, fabric preferences, preferred clothing and footwear brands, outfit categories, occasions and budget.

We may also retain quiz responses, saved preferences and recommendation history to support your shopping experience.

We use this information to support clothing selection and sizing. We do not require medical diagnoses or health records for our styling service.

24.3 Order and Transaction Information

We may collect information about the products and outfits ordered, selected sizes, quantities, order numbers, dates, values, payment status, transaction references, delivery tracking, returns, exchanges and refunds.

Payment providers may collect card or banking information needed to process your payment. Please do not send full card details, PINs or banking passwords to us by email or through customer support.

24.4 Customer Support Information

We may retain messages, enquiries, complaints, return reasons and supporting material you provide.

If you submit a photograph to demonstrate an incorrect or damaged product, please avoid including unrelated people or unnecessary personal information.

24.5 Technical and Website Information

Our website and its service providers may collect your IP address, browser and device information, operating system, pages visited, website interactions, access times, referring pages, cookie identifiers and diagnostic, security or error logs.

The information collected depends on the features and technologies used during your visit.

25. How We Collect Information

We generally collect information directly from you when you create or update an account, complete the style quiz, place an order, save preferences or looks, submit a return request, contact customer support or subscribe to marketing communications.

We may receive relevant information from payment, delivery and technology providers, such as payment confirmation, delivery status and website security information.

Where another person supplies your details for delivery purposes, we use those details only for the relevant transaction and related lawful purposes.

We collect information indirectly only where permitted by law.

26. Why We Use Your Information

We process personal information to administer accounts, provide personalised outfit recommendations, save preferences, process orders, confirm payments, arrange delivery, provide order updates, handle returns and refunds, respond to enquiries and resolve complaints.

We may also process information to maintain accounting records, detect fraud, protect our website, diagnose technical problems, improve our service, send permitted marketing communications, comply with legal obligations and establish or defend legal claims.

We limit the information we process to what is reasonably necessary for these purposes.

If we intend to use information for a materially different purpose, we will assess whether that use is lawful and compatible with the original purpose, and provide further notice or obtain consent where required.

27. Our Grounds for Processing

We process personal information only where a lawful ground under POPIA applies.

Depending on the activity, processing may be based on your consent, steps taken at your request before entering into a contract, performance of a contract, compliance with a legal obligation, protection of your legitimate interests or pursuit of legally justified legitimate interests belonging to us or a third party.

We do not treat visiting our website or accepting our Terms of Service as blanket consent to every use of your information.

Where processing depends on consent, you may withdraw that consent. Withdrawal does not affect processing that was lawful before withdrawal or processing supported by another lawful ground.

28. Required and Optional Information

Certain information is necessary to provide the service you request.

For example, we need appropriate contact and delivery information to fulfil an order. Without it, we may be unable to complete your purchase or deliver the goods.

Our personalised recommendation service uses quiz responses to identify suitable looks. Fields required to complete that service will be indicated in the quiz. Without sufficient information, recommendations may be unavailable or less relevant.

Marketing consent is optional and is not a condition of purchasing from Good Elevation.

Where information is required by law, we will explain this where relevant.

29. Style Recommendations and AI

Our human stylists select and combine products into complete outfits. Technology and AI support the recommendation of those human-curated looks.

The recommendation process may compare your quiz responses, measurements, preferences and budget with available outfit information.

Where an external AI service processes information for recommendations, we will limit the information supplied to what is necessary and apply the relevant privacy, security and cross-border safeguards.

Our styling service is not intended to make decisions that produce legal consequences or similarly significant effects concerning you. You remain free to choose whether to purchase a recommended outfit.

You may contact us to question a recommendation or correct the information used to generate it.

Any future use of solely automated decision-making that falls within POPIA’s restrictions will require the applicable lawful basis and safeguards.

30. Cookies and Similar Technologies

Our website may use cookies and similar technologies to support its operation.

Essential technologies support security, shopping carts, checkout and account access. Preference technologies remember choices and settings. Analytics technologies help us understand website performance and usage. Advertising technologies may measure or personalise advertising where enabled and lawfully permitted.

Where consent is required, optional technologies will be used only after that consent has been obtained.

You can manage cookies through your browser settings and any consent controls provided on the website. Blocking essential cookies may affect some website functions.

Information about specific optional cookies and their providers will be provided through the applicable cookie notice or consent interface when those technologies are used.

31. Marketing Communications

We send electronic direct marketing only where permitted by POPIA.

This may be based on your consent or, where the legal requirements are met, an existing customer relationship involving our own similar products or services.

Where we rely on the existing-customer provision, you will be given an opportunity to object when your contact details are collected and in each marketing communication.

You may unsubscribe through the method provided in a message or email sboniso@goodelevation.co.za.

We will honour marketing objections and will not charge you to opt out.

Necessary service messages, such as payment confirmations, delivery updates and return communications, may continue after you unsubscribe from marketing.

32. Sharing Your Information

We may share relevant information with Shopify and other storefront providers, hosting and database providers, technical support providers, AI recommendation providers, payment processors, fraud-prevention providers, couriers, customer support providers and communication providers where necessary and lawfully justified.

We may also disclose relevant information to professional advisers, authorities or other parties where legally required or necessary to protect lawful rights.

We do not sell your personal information.

We do not share your individual quiz responses with clothing brands for their independent marketing without an appropriate lawful basis and notice.

Where a provider acts as an operator on our behalf, we require appropriate contractual obligations concerning confidentiality, security and authorised processing.

Some providers act as independent responsible parties for their own lawful activities. Their privacy notices apply to those activities.

33. Transfers Outside South Africa

Some technology, hosting, payment or AI providers may process information outside South Africa.

We will transfer personal information internationally only where a permitted ground under section 72 of POPIA applies.

This may involve adequate protection under the recipient’s applicable law, binding corporate rules or a binding agreement; your consent; a transfer necessary to perform a contract with you or qualifying steps taken at your request; or another transfer ground expressly permitted by POPIA.

Where relevant, safeguards will address onward transfers to other recipients.

You may contact us for information about international processing relevant to your use of our services.

34. Retention of Personal Information

We retain personal information only for as long as reasonably necessary for its purpose, unless longer retention is required or permitted by law.

Retention periods depend on account activity, the continued need for saved preferences, statutory recordkeeping requirements, outstanding orders or complaints, legal claims and security or fraud-prevention requirements.

We review information for deletion or de-identification when it is no longer needed.

If you request account deletion, some transaction or legal records may still need to be retained. We will explain any applicable retention requirement.

Where information remains temporarily in protected backups, it will be managed through the relevant backup retention cycle and will not be restored for unrelated use.

35. Security Safeguards

We take appropriate and reasonable technical and organisational measures to protect personal information against loss, unauthorised access, disclosure, alteration or destruction.

Our security arrangements are assessed against the information involved and reasonably foreseeable risks. Relevant measures may include access controls, secure transmission, system monitoring, provider safeguards and restricted staff access.

We require persons authorised to handle personal information to maintain confidentiality.

No online system can guarantee absolute security. Please protect your login credentials and notify us if you suspect unauthorised access to your account.

36. Security Compromises

If there are reasonable grounds to believe that your personal information has been accessed or acquired by an unauthorised person, we will investigate and take appropriate steps to contain the incident.

We will notify the Information Regulator and affected individuals as required by section 22 of POPIA, as soon as reasonably possible, subject to lawful exceptions or delays.

Where notification is required, it will include available information that helps you understand the incident and take protective measures.

37. Your Privacy Rights

Subject to applicable legal requirements and exceptions, you may ask whether we hold personal information about you, request access to that information and request information about relevant third-party recipients.

You may ask us to correct inaccurate, incomplete, misleading or outdated information, or request deletion of information that we are no longer authorised to retain.

You may object to qualifying processing on reasonable grounds relating to your circumstances, object to direct marketing and withdraw consent where processing relies on consent.

You may also raise concerns about qualifying automated decisions, lodge a complaint with the Information Regulator and exercise other remedies available under applicable law.

Deletion and objection rights are not absolute. We may need to retain or process certain information to comply with the law or another applicable lawful ground.

38. Making a Privacy Request

Email sboniso@goodelevation.co.za with the subject “Privacy Request” and explain the assistance you need.

Please provide enough information for us to identify the relevant account or records.

We may request reasonable proof of identity before releasing or changing personal information. We will limit verification information to what is necessary.

We will respond within the period required by applicable law. If we cannot grant a request, we will explain the reason and available options.

Prescribed forms or procedures under POPIA or the Promotion of Access to Information Act (PAIA) may apply. Any legally permitted access fee will be explained before it is charged.

39. Children’s Personal Information

Our services are intended primarily for adults.

We do not knowingly process a child’s personal information unless a lawful exception under POPIA applies, including consent from a competent person where required.

A parent or legal guardian should supervise any use of our services involving a child’s information. Permission to make a purchase does not automatically authorise every use of that child’s information.

If you believe a child’s information has been collected unlawfully, please contact us so that we can investigate and take appropriate action.

40. Special Personal Information

We do not require information about religious beliefs, race, political views, trade union membership, medical conditions, criminal history or biometric identification for ordinary outfit recommendations.

Please avoid providing unnecessary sensitive information in quiz responses or support messages.

If information we receive falls within POPIA’s special personal information provisions, we will process it only where an applicable authorisation or exception permits us to do so.

41. Third-Party Privacy Practices

Our website may contain links to external websites.

Those websites are responsible for their own information-handling practices. Please review their privacy notices before providing personal information.

This does not remove Good Elevation’s responsibility for information processed by providers acting on our behalf.

42. Complaints to the Information Regulator

You may contact us about a privacy concern, but you are not required to resolve a complaint with us before exercising your right to approach the Information Regulator.

43. Changes to the Privacy Policy

We may update this policy to reflect changes in our services, processing activities or legal obligations.

The latest version will be published on our website with an updated date. Where required, we will provide additional notice of material changes.

A policy update does not replace any consent or other legal requirement applicable to a new processing activity.
